1. SCOPE OF SERVICES
Nicolas John Landscapes agrees to provide the following Garden Care Program services to the Client's property at 15 Everage Street, Moonee Ponds VIC 3039, on a fortnightly basis in accordance with the terms of this agreement:

Raised Planter Box ManagementIndividual planter condition checks; soil moisture monitoring; plant health inspection and grooming; feeding and fertiliser application as required
Irrigation MonitoringIrrigation check every visit; controller and timer review; zone-by-zone inspection; leak and blockage identification; minor adjustments included. Major repairs: fee for service @ $95/hr (min. 1.5hrs)
Plant Health MonitoringOngoing pest and disease surveillance; early intervention and minor treatments; recommendations for plant replacement or enhancement; seasonal care adjustments
Green Waste & Site CleanlinessFull green waste removal and disposal each visit; clean communal garden and relaxation areas; paths and entry areas kept immaculate
Additional Services (Quoted Separately)
The following services are excluded from the fixed program rate and will be quoted separately upon request: plant supply and replacement; mulch installation or top-ups; major irrigation repairs or upgrades (fee for service @ $95/hr, min. 1.5hrs); specialist pest and disease treatments; access equipment (if required); landscape design or redesign works; hardscape repairs or installation.
2. INVESTMENT
2.1 Initial Base Clean (One-Time)
Prior to commencement of the ongoing program, a one-time Initial Base Clean is required to restore the garden to a healthy, maintainable standard. This includes corrective pruning, removal of weeds, and removal of unwanted plant species.

2.2 Ongoing Fortnightly Garden Care Program

Pricing scales by frequency: weekly visits are more efficient per visit. Monthly available as reactive-only service.

3. TERMS & CONDITIONS
3.1 Agreement Term
This agreement constitutes a legally binding Service Agreement upon execution by both parties. A minimum initial term of three (3) months applies from the commencement date. Following the initial term, the agreement continues on a rolling monthly basis. Either party may terminate with thirty (30) days written notice.
3.2 Cancellation & Service Protection
No cancellation is accepted within the first three (3) months; cancellation during this period incurs a fee equal to the remaining invoiced visits. Following the minimum term, 30 days written notice is required. NJ Landscapes may terminate immediately for non-payment, unsafe conduct, repeated denial of access, or material breach. Re-engagement within 12 months incurs a re-onboarding fee of $250 + GST. No partial refunds for unused days within a prepaid period.
3.3 Payment Terms
Services are invoiced monthly in advance. Payment is due within twenty-eight (28) days of the invoice date. Overdue accounts incur a late payment fee of 2% per month. All invoices are in AUD and include GST, itemised separately on each tax invoice.
3.4 Annual Price Adjustment (CPI)
Program pricing is fixed for the initial 12-month period. Thereafter, rates may be adjusted annually in line with the Melbourne CPI (ABS). Any adjustment will be communicated in writing a minimum of 30 days prior to taking effect.
3.5 Scope of Works
Services are limited to those described in this agreement. Any works outside agreed scope will be assessed, quoted, and authorised in writing before commencement.
3.6 Service Scheduling & Variations
Fortnightly services are performed on an agreed scheduled day. NJ Landscapes may reschedule visits affected by severe weather or public holidays. Visits forfeited due to client access restrictions will not be credited.
3.7 Access & Site Conditions
The client is responsible for ensuring safe, unobstructed access on each scheduled service day, including gate codes, key access, and parking. Changes to access arrangements require a minimum of 48 hours notice.
3.8 Plant Health & Professional Liability
NJ Landscapes applies industry-standard horticultural practices. Plant health outcomes may be influenced by factors outside our control. Our liability in all circumstances is limited to the value of services rendered in the preceding one (1) month.
3.9 Insurance
NJ Landscapes holds public liability insurance of $20,000,000 per occurrence and workers compensation insurance for all employees in accordance with Victorian legislation.
3.10 Dispute Resolution
Disputes shall first be resolved through direct negotiation. If unresolved within 14 days, either party may refer the matter to mediation, and thereafter to VCAT or a court of competent jurisdiction in Victoria.
4. EXECUTION
By signing below, both parties confirm they have read, understood, and agree to be bound by the terms of this Service Agreement. This agreement is effective from the commencement date agreed upon by both parties.

The Rise features a beautiful upper-level communal garden area designed as a relaxation retreat for residents. Like many well-designed spaces, the garden has reached a point where it needs a focused intervention — removing unwanted species, correcting overgrown plantings, and restoring the garden to its intended standard.

Our proposal is structured in two parts: a one-time Initial Base Clean to reset the garden, followed by a fortnightly ongoing maintenance program to sustain and elevate that standard permanently.
